Stay Informed: Legal Penalties for System Misuse Under the PSW Act, 2021

PSW is a secure, centralized platform designed to simplify compliance and ensure transparency in cross-border trade. To maintain the integrity of Pakistan’s digital trade ecosystem, users must ensure that all access and activities on the PSW system are authorized and compliant with the PSW Act, 2021. Any unauthorized access, data manipulation, or misuse of the PSW system, or any connected or ancillary system, is a punishable offence under the PSW Act, with penalties that may include imprisonment, fines, or both.

Examples of offences include:

• Unauthorized access, copying, or transmission of PSW data
• Interference or damage to PSW systems or data
• Fraudulent use or tampering of information or credentials
• Use or distribution of malicious software to harm PSW systems

Depending on the nature of the offence, punishments may range from six months to four years of imprisonment and fines up to PKR 5 million, along with possible confiscation of devices used in the offence.
